LTFRB Warns TNVS, PUVs: Enforce Fare Discounts or Face Fines

The Land Transportation Franchising and Regulatory Board (LTFRB) has issued a stern warning to operators and drivers of Transport Network Vehicle Services (TNVS) and Public Utility Vehicles (PUVs) to comply with fare discount laws for senior citizens, persons with disabilities (PWDs), and students. The warning was made on December 16 by LTFRB Chairperson Atty. Teofilo Guadiz III.

Upholding Rights Amid Rising Costs

Chairperson Guadiz emphasized the agency’s commitment to safeguarding the rights of marginalized groups amid rising transportation costs. Under Republic Act No. 9994 (the Expanded Senior Citizens Act of 2010) and Republic Act No. 7277 (the Magna Carta for Disabled Persons), a mandatory 20% fare discount must be given to senior citizens and PWDs. Additionally, LTFRB memorandum circulars mandate a similar discount for students on school days and holidays, including weekends and vacations, ensuring round-the-clock application of the rule.

“Honoring these discounts is both a legal obligation and a moral duty,” Guadiz said. “Non-compliance not only violates the law but also undermines the rights of the commuting public.”

Persistent Non-Compliance Sparks Action

Despite clear guidelines, complaints of non-compliance have been reported. Passengers, particularly those using TNVS platforms, have highlighted difficulties in applying discounts. Reports also reveal cases where jeepney and bus drivers refuse to honor valid IDs or charge full fares, leaving passengers disadvantaged.

The LTFRB stressed that such practices are a disservice to the public and go against the law. The agency warned operators and drivers that non-compliance will result in stiff penalties, including fines, suspension of franchise operations, or even franchise revocation for repeat offenders.

Strengthening Enforcement and Reporting

The LTFRB has ramped up its monitoring efforts to ensure compliance. The agency has urged passengers to report incidents of non-compliance, providing details such as the vehicle’s plate number, time of the incident, and any supporting evidence like receipts or screenshots. Complaints can be submitted through the LTFRB’s hotline or official social media pages.

To address concerns specific to TNVS platforms, Guadiz called on companies to upgrade their systems, making it easier for eligible passengers to apply discounts. PUV operators were also reminded to educate their drivers about the legal requirements and consequences of non-compliance.

Educating the Sector for Better Compliance

Chairperson Guadiz underscored the importance of awareness and education among transport operators and drivers. “Ensuring that drivers and operators are informed about these laws is a crucial step in fostering a culture of fairness and responsibility,” he noted.

The LTFRB has committed to launching additional initiatives to educate both the public and transport providers on the importance of fare discounts. These efforts aim to reduce the financial burden on vulnerable sectors while creating a more inclusive transportation system.
